BOOKING ACKNOWLEDGEMENTS (REQUIRED)

Wheel studs / lug nuts / bolts

I understand that wheel fasteners and studs/bolts can be weakened by prior service, over-torquing, cross-threading, corrosion, or age. If a stud, lug nut, or bolt breaks, strips, or seizes during removal or installation, Sparky X is not responsible for the damage, replacement parts, or delays. If parts are available, replacement can be performed at additional cost.

TPMS sensors not supplied and Installed by Sparky X

I understand Sparky X is not responsible for damage or failure of TPMS sensors, valve stems, service kits, or related components that were not supplied and installed by Sparky X, or that are corroded, seized, worn, or previously damaged/incorrectly installed. If a sensor fails during service, replacement and programming/relearn are at my cost (quotation provided before proceeding).

Re-torque notice (owner responsibility)

I acknowledge it is my responsibility to have wheel fasteners re-torqued after 50–100 km (30–60 miles) of driving, or sooner if vibration occurs. Sparky X offers a complimentary in-shop re-torque by appointment. For convenience, an on-site re-torque at my location is available within the service area for a $50 convenience fee + HST (by appointment).

Tire repair warranty

  • I understand Sparky X warrants eligible puncture repairs for the usable life of the tire (down to 2/32") when used under normal service conditions.

  • Eligible repairs: single punctures ≤ 1/4" (6 mm) located in the tread crown, repaired from the inside with an industry-standard combination plug-patch where applicable, or a temporary plug (roadside emergencies).

  • Speed Rating Notice: After a TIA/USTMA-compliant puncture repair, the tire’s original speed rating no longer applies. Avoid sustained high-speed use; replace if high-speed performance is required.

  • Exclusions: shoulder or sidewall injuries; holes > 1/4"; cuts/tears/impact damage; multiple or overlapping punctures; tires driven flat or severely underinflated; chemical sealants; age/weather cracking; misuse (overload, overspeed, racing/off-road); or previous improper repairs.

  • Roadside/emergency fixes: any external/temporary roadside repair is temporary only and carries no warranty. The tire must be replaced or brought back to Sparky X for a proper internal repair as soon as possible.

  • Remedy: at Sparky X’s option, we will re-repair the eligible puncture or refund the original repair charge. Consequential damages are not covered. I am responsible for maintaining correct tire pressure and inspecting the tire after repair.

1. Acceptance of Terms

By accessing or using the Sparky X website (https://sparkyx.ca/) or any of its services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Services.  

2. Services

Sparky X provides mobile tire repair, roadside assistance, and other related services. The specific services offered may change from time to time.

3. User Conduct

You agree to use the Services in compliance with all applicable laws and regulations. You will not:

  • Use the Services for any unlawful purpose or in a manner that violates these Terms.

  • Impersonate any person or entity, or falsely represent your affiliation with a person or entity.

  • Interfere with or disrupt the operation of the Services.  

  • Transmit any viruses, worms, or other malicious code.

  • Collect or harvest information about other users.

4. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Sparky X or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content from the Site without prior written permission from Sparky X.  

5. Limitation of Liability

Sparky X shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with the use or inability to use the Services.  

6. Indemnification

You agree to indemnify and hold Sparky X harmless from any claims, liabilities, damages, and expenses arising out of or in connection with your use of the Services or your violation of these Terms.  

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Ontario.  

8. Changes to Terms

Sparky X reserves the right to modify these Terms at any time. Any changes will be effective upon posting on the Site. Your continued use of the Services after such changes have been posted will constitute your acceptance of the modified Terms.
