Sparky X Terms of Service & Booking Acknowledgements

I. REQUIRED BOOKING ACKNOWLEDGEMENTS

By submitting a booking, the Customer ("you") confirms they have read, understood, and agreed to the following technical and safety terms.

1. Wheel Fasteners (Studs, Lug Nuts, and Bolts)

I understand that wheel fasteners and studs/bolts are subject to pre-existing fatigue caused by prior service, over-torquing, cross-threading, corrosion (road salt), or age.

  • Liability: Sparky X is not responsible for fasteners that break, strip, or seize during removal or installation due to these pre-existing conditions.

  • Remedy: If a failure occurs, Sparky X will provide a quote for replacement parts or labour if an on-site repair is feasible. Additional costs and service delays may apply.

2. TPMS Sensors (Tire Pressure Monitoring System)

I understand that Sparky X is not responsible for the failure or damage of TPMS sensors, valve stems, or service kits that were not originally supplied and installed by Sparky X.

  • Risk Notice: Sensors that are corroded, seized, or have brittle stems may fail during standard tire demounting/mounting.

  • Resolution: If a sensor fails during service, any required replacement or programming/relearn will be performed at my expense (a quotation will be provided before proceeding).

3. Mandatory Re-Torque Notice (Owner Responsibility)

I acknowledge that it is my sole responsibility to have wheel fasteners re-torqued after 50–100 km (30–60 miles) of driving, or immediately if any vibration occurs.

  • Complimentary Option: Sparky X offers a free in-shop re-torque at our Ajax hub by appointment.

  • Mobile Option: On-site re-torque at your location is available within our service area for a $75.00 convenience fee + HST.

  • Warning: Failure to re-torque wheel fasteners is a safety hazard and may lead to wheel separation.

4. Tire Repair Warranty & Safety Standards

  • Warranty: Sparky X warrants eligible puncture repairs for the usable life of the tire (down to 2/32" tread depth).

  • Speed Rating Disclosure: Per TIA/USTMA standards, once a tire has been punctured and repaired, its original speed rating is voided. The tire should be treated as non-speed-rated; avoid sustained high-speed driving.

  • Exclusions: No warranty is provided for shoulder/sidewall injuries, holes > 1/4", tires driven flat (run-flat damage), or previous improper repairs.

  • Emergency Plugs: Temporary external roadside "plugs" are not warrantied. The tire must be brought to Sparky X for a permanent internal patch-plug repair as soon as possible.

II. WEBSITE & BUSINESS TERMS OF SERVICE

1. Acceptance of Terms

By accessing the Sparky X website ([suspicious link removed]) or utilizing our mobile services, you agree to be bound by these Terms of Service. These terms are governed by the laws of the Province of Ontario, Canada.

2. Service Area & Site Safety Requirements

Sparky X provides mobile service at residential driveways and workplaces. To ensure safety and compliance with Ontario workplace standards:

  • Site Criteria: We require a minimum of five (5) feet of level clearance around the vehicle.

  • Restricted Locations: We cannot perform service on public streets where parking is restricted, inside underground condo parking garages, or on unstable/steeply inclined ground.

  • Refusal of Service: Sparky X reserves the right to cancel or reschedule if the technician deems the site unsafe or inaccessible.

3. Cancellations & No-Show Fees

  • Notice: For appointments scheduled more than 24 hours in advance, we require 24 hours' notice for cancellation.

  • Fees: Cancellations with less than 24 hours' notice, or "No-Shows" where the vehicle is not present/accessible, will incur a $50.00 + HST cancellation fee.

4. Estimates & Accuracy (Ontario CPA 2026)

  • Estimates: All online pricing is an estimate. Per the Ontario Consumer Protection Act, we will provide a final digital estimate before work begins. Final charges will not exceed the estimate by more than 10% without your written or digital consent.

  • Location & Inventory: We use Location Detection and the TireConnect Widget to show real-time local stock. While we strive for 100% accuracy, Sparky X is not liable for inventory discrepancies or third-party data errors.

5. AI Assistant (Sparky XAI) & Communication

  • AI Usage: Our AI assistant (powered by Chatbase) provides information for your convenience. Please do not share sensitive financial data in the chat.

  • Privacy: By using our AI Chatbot or WhatsApp link, you agree to our Privacy Policy regarding the processing of communication data for service scheduling.

6. Intellectual Property

All content, including text, tire guides, and logos, is the property of Sparky X or its licensors. Unauthorized reproduction is strictly prohibited.

7. Limitation of Liability

Sparky X shall not be liable for indirect, incidental, or consequential damages (including loss of profits or business interruption) arising out of the use or inability to use our services.
